§ 1 Applicability & offeror

  • The product range in our online shop is exclusively aimed at buyers who have reached the age of 18 years.

  • Our deliveries, services and offers are made exclusively on the basis of these general terms and conditions. The inclusion of terms and conditions of a customer, which contradict our terms and conditions, is already contradicted.

  • Contract language is exclusively German.

  • You can view and print the currently valid terms and conditions on the website.

§ 2 Conclusion of the contract

  • The product range in our online shop represents a binding purchase offer, which is accepted by your order.

  • If you have chosen PayPal as payment method, the sales contract is completed at the time of confirmation of the payment order to PayPal.

  • If you have chosen SOFORT as payment method, the sales contract is completed at the time of confirmation of the payment order to the Sofort Gmbh.

  • Immediately after receiving your order we confirm - with an e-mail - the completed sales contract and the receipt of your order..

  • Orders can only be placed on our website.

§ 3 Prices, payment & shipping

  • Due to the small business regulation (Kleinunternehmerregelung) all indicated prices are VAT-exempt final prices.

  • The final prices do not include the costs for packaging and shipping.

  • You can pay via PayPal or SOFORT (direct deposit|Wix Payments). When paying by PayPal, you must register at www.paypal.com. The terms of use of paypal.com apply.

  • We ship exclusively to countries of the European Union. The indication of delivery dates is without obligation. In any case, we ship within the statutory delivery time from the order date of 30 days.

  • The ordered goods will be shipped only after receipt of payment on our bank account.

§ 4 Right of cancellation

  • You may revoke your purchase contract within a period of fourteen days without giving reasons. The withdrawal period is fourteen days from the date on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

  • To exercise your right of cancellation, you must inform us

  • by means of a clear explanation by post, mail, fax, phone, or e-mail) of your decision to withdraw from this contract. You can use the enclosed withdrawal form for that, but this is not mandatory. You can download this form  HERE.

  • In order to maintain the cancellation period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the cancellation period.

  • If you withdraw from this contract, we refund you all the payments that we have received from you, including delivery costs immediately, at the latest within fourteen days from the date on which we have received the message of your cancellation of this contract.  For this refund we use the same payment method that you used for the initial transaction, unless you explicitly agreed otherwise; in no case you will be charged fees for this refund.

  • We may refuse repayment until we have received the goods or until you have provided proof that you have returned the goods, whichever is the earlier.

  • You must return the goods to us immediately and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is fourteen days.

  • You bear the full costs of returning the goods.

  • You only have to pay for a possible loss in value of the goods, if this loss of value is due to a handling that is not necessary for the examination of the characteristics and functioning of the goods.

§ 5 Retention of title

  • Until full payment, the goods you ordered remain our property

  • In case of default of payment, we are entitled to assert our rights under the retention of title. It is agreed that the assertion of the retention of title is not a withdrawal from the contract, unless we expressly declare the withdrawal from the contract.

§ 6 Transfer of risk & transport damage

  • Risk transfer from the seller to the buyer when the goods pass over to the delivery service. This means that from this point you carry any risk of deterioration or loss of the goods on the transport route and therefore have to pay the purchase price.

  • Up to a value of EUR 500.00, the shipped goods are insured against damage due to intent and/or culpable negligence.

  • If goods are delivered with obvious damage, please complain about such defects immediately to the deliverer and please contact us as soon as possible.

  • The neglect of a complaint or contacting has no consequences for your statutory warranty rights. However, you help us assert our own claims against the deliverer or the transport insurance.

§ 7 Warranty & guarantee

  • You are entitled to a statutory warranty right. The warranty period for consumers is 2 years from delivery of the goods.

  • If safety/assembly instructions are not followed or changes are made to the goods, any warranty claim for the goods expires.

  • In the case of a warrantable defect, we reserve the right to repair the goods or to deliver a substitute equivalent.

  • The Warranty does not cover wear and tear through normal use of the goods.

  • In addition to the statutory warranty, we provide no further guarantees.

  • The costs of warranty-related returns will be paid by us.

§ 8 Governing law & jurisdiction

  • The law of the Republic of Austria shall apply, excluding the provisions of the United Nations Convention on Contracts for the International Sales of Goods (CISG). Compulsory regulations of the country in which you usually reside, remain unaffected by the choice of law.

  • Any dispute under these Terms and Conditions or arising out of use of this Website shall be subject to the exclusive jurisdiction of Austrian courts.

§ 9 Alternative settlement of disputes

  • The EU Commission has provided a platform for out-of-court settlement. This gives consumers the opportunity to settle disputes in connection with their online order without the intervention of a court.

  • The platform for online dispute resolution can be reached at the external link http://ec.europa.eu/consumers/odr/.

  • We endeavor to settle any disputes arising from our contract by mutual agreement. In addition, we are not obliged to participate in arbitration and unfortunately can not offer you participation in such a procedure.

§ 10 Copyright

  • All text, pictures and graphics used on our homepage are the property of Fatal Fingers e.U. and copyrighted.
